You're not facing criminal liability. And this is not a legal question, it's a math question. You were paid the correct amount of money by your insurance company based on the $2400 estimate. Your insurance company was responsible for paying for the $2400 repair minus your $1000 deductible. That's $1400, which was paid to the collision shop. Not much can be done about a short delay on a first party claim from a legal angle. Unless you want to spend several thousand dollars out of pocket to make a point. As a general rule, insurance carriers don't "provide" a rental - but rather reinburse your expenses for one. You will need to hire a lawyer to handle this. If the accident was someone elses fault, yand you were injured, ou need an injury lawyer. They will often take cases on a contingent fee. Otherwise, you will need to pay for a lwyer out of pocket to intervene and addres this issue.

So you will either need to trust your insurance company about what the policy says, or get a copy and read it yourself.
Most policies are complicated. They are also different from each other (vastly). So we can't tell you some general rule. It depends on what your policy says.
I will tell you that I have handled cases where there was a huge fight about whether coverage still applied because of a move from one state, to another, with a transfer of insurance. So I would not mess around with this.
If you want to be safe, your best bet is to buy the coverage for the new state as soon as you possibly can. Until then, you are in the danger zone and possibly may not have coverage if/when you need it.

Linda, if the question focuses on a contract that mat not have been fully executed, then the answer depends in part on whether the parties, you and the PA, acted consistent with the terms of the contract. If the PA performed consistent with the agreement and the question is whether the contract does not have to be honored because you did not receive an executed copy of the report, then, and without having the opportunity to review the agreement or the work performed, it is likely you will have to honor. It appears that a fully executed copy of the report exists, you can request from the insurance company or PA.

The problem here is the WHY...I suspect you have more than a $1,000.00 deductible and thats what the insurance company said in the declination letter. You will need to hire a lawyer, possibleat some expense, to review your claim and policy to see why the insurance company has paid nothing. This needs to be addressed ASAP as you are 5 months post event and not resolved this issue. ... Read More

You should hire counsel immediately to represent you in pursuing a claim against the at fault driver. Additionally, you should not give any statements to the other sides insurance company and take photos of the car wreck before the repairs are completed

This is a problem with third party property damage cases, especially for low end cars. They aren't worth spending money on to litigate over, the inurance carrier knows this and lowballs and lawyers won't take the cases on a contingent fee, again, not financially viable. This is why its critical ot have collision coverage on your car. Your remedy is to file a lawsuit against the at fault driver for damages - though you may be throwing good money after bad doing so, unless the insurer capitulates. ... Read More
