Misrepresentations on application

Before I got my policy for business insurance me and my agent talked about my prior losses. She told me she could only quote me for my business and not my house due to my prior losses but she gave me the number to a lady I could go through to get the insurance for my house instead. For some reason on my application she marked NO for me having prior losses, the application I never saw or signed. I filed a fire claim 3 months later and When I had my EUO I must’ve mistaken the question when they ask did I tell my agent about my prior losses because in the transcript it said I said NO however I don’t recall saying that for it makes no sense for me to say that. Once I realize what was going on I emailed my agent and I asked her did she remember giving me the lady number for my house insurance because she couldn’t due to my prior losses and she said YES. My claimed was denied cause she marked NO on the app. Do I have a lawsuit here or would that mistake at The EUO make me lose a lawsuit.

Based upon your summary of the facts, your misrepresentation of prior losses is enough to allow the insurance company to cancel your policy and not to pay your claim. You would lose!
