How do I fight an insurance company?

More details to this question:
There was no personal injury. The other driver was found at fault. I have the appraisal information from the other drivers insurance company which deemed my vehicle repairable and valued at $5150. The other parties insurance however is stating my vehicle is a total loss and worth $1828. I don't have collision with my insurance, and have no idea what to do or who to contact. I need my vehicle to drive my son from Palm Bay to Port St. John to school. My car is a 2006 Toyota Prius.

This is a problem with third party property damage cases, especially for low end cars. They aren't worth spending money on to litigate over, the inurance carrier knows this and lowballs and lawyers won't take the cases on a contingent fee, again, not financially viable. This is why its critical ot have collision coverage on your car. Your remedy is to file a lawsuit against the at fault driver for damages - though you may be throwing good money after bad doing so, unless the insurer capitulates.
