No idea about the solution without knowing the issues. If you don't have your own collision coverage you will have to wiegh the expense of hiring a lawyer to address the issues in the claim and possibly suing the at fault indiividual if you think he is collectible.

If your doctor wrote up the need for the MRI correctly and your insurance company pursuant to the contractual terms was required to do the MRI or that reasonably should have done so you do have a legal claim to sue the insurance company for the extra year of your pain and suffering. If the outcome of your surgery is the same regardless of when you had the MRI that would cut off your damages. The terms of your insurance policy will ultimately dictate if you have a lawsuit....
