who pays for the hospital bill if my son was taken to the ER by ambulance due to chemical spill?

Answered 12 years and 9 months ago by Thatcher Stone (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Insurance
First thing you need to do is make a written demand on the school district in a certified letter for the payment of these expenses. If they refuse to pay you will need to sue them. Get a lawyer, and sue them. Feel free to call our office if you have more questions. Someone at the school was negligent with the chemicals and spilled them. It was forseeable that if there was a spill, children might need medical attention. That's exactly what happened, from your story. SO go chase the school district.... Read More

Probably wise for you to consult with an attorney.  Generally speaking, if your own auto insurance company is asking for a statement, you have to give it to them pursuant to a condition in your insurance contract that requires you to cooperate with their investigation into your claim.  However, where they have denied your claim, there should be no reason they need a statement from you (unless they are denying your claim because you failed to give a statement or failed to cooperate).  Talk with an experienced attorney about the denial of your claim.  If the claim was improperly denied, you may have a claim against the insurance company.  It would be best for you to speak with an attorney before you agree to give a statement to the insurance company, and would probably be a good idea to have him/her present during the giving of your statement.  Good luck.... Insurance company can't pay if you are not beneficiary. You should open up a probate estate for your mother and if appropriate make insurance claim as PR of her estate. Creditors and other heirs/beneficiaries may have claims but the matter will be resolved in probate. You should seek legal representation.   Charles Sanford... Read More

Insurance low offer for pain and suffering

Answered 12 years and 10 months ago by Mr. James Jenkins Mills (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Insurance
Typically, it is worthwhile to hire an attorney to handle these types of claims.  While you will have to pay the attorney a percentage of any recovery, I think there are plenty of studies out there that indicate that the client ends up with more if they hire an attorney.  However, if you get too far along with negotiations with the insurance company, attorneys are going to be very hesitant to take on your case.  I would suggest that you at least talk with someone now (attorneys don't charge for these types of consultations, or at least, they shouldn't charge).  That way, you will know more about the process, what to expect, etc., and you can make a decision as to whether you should hire an attorney. Either way, good luck going forward. -Jay Mills James J. Mills 2626 Glenwood Ave., Ste. 560 P.O. Box 10867 Raleigh, NC 27605 Telephone: 919.235.3824 Fax: 919.782.2311 www.burnsdaypresnell.com... Is personal condo policy coverage for damages or upgrades only?

Answered 12 years and 10 months ago by Lawrence N Lavigne (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Insurance
As a general rule, a condo owner is responsible for the inside walls in.  Meaning, if an appliance causes water damage in the unit, the unit owner and their insurance is responsible.  The condo policy generally really only covers damage to the building(s) and common areas.

Do I have to split life ins money if I was the beneficiary?

Answered 12 years and 10 months ago by Sarah Reese (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Insurance
I am sorry to hear about this.  If you are the only beneficiary policy was entered into while your dad was of sound mind and not under any duress, then you are likely the sole person entitled to the funds.  However, since it is being challenged by your brothers and you have been served with a restraining order advising you to not take any action with the funds, I must recommend that you obey the order until this matter is resolved.  Depending on the details of this matter, you may want to seek legal assistance.  Best of luck! Is Loss of Use applicable for perils covered under an endorsement?

Answered 12 years and 11 months ago by Thatcher Stone (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Insurance
Well the precise correct answer depends uppon a read of the policy. If the policy is clear that the sewer endorsement adding a peril had a different limit of liability than the balance of the coverage, then there could be an issue for obtaining the exta coverage you seek. However, it depends on the wording also of the habitability coverage and its wording. Unable to answer definitively without sight of the policy. got hit from the rear by a goverment oficial vechile driven by a US Air Force Guy

Answered 12 years and 11 months ago by Thatcher Stone (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Insurance
First step, you probably have uninsured motorist coverage. Call your insurance company and make a claim ASAP. Have you done this? IF NOT YOU MUST RIGHT AWAY. Most insurance companies will not pay a claim unless you make timely notice. Suing the government is an endless hassle. Let your insurer take care of it. If you do not have uninsured motorist coverage, which I find hard to believe, then call the other driver and ask him for a copy of the insurance report he made to the Air Force. Then make a call to that person and demand payment. If they waffle get in touch with a local lawyer.    ... Read More

Hurricane sandy destroyed my neighborhood, what should we do?

Answered 13 years ago by Thatcher Stone (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Insurance
The right answer to this is not what you will want to hear. Generally home insurance policies do not respond to a widespread felt risk. Each of you will have to have a lawyer review your policy language to make a determination. If there is an issue in the homeowners' policy that you feel the insurers are being unfair about, some of you could get together and bring a class action or individual actions if necessary.  Our office is available to review policy language with no obligation and no attorney cost to see if there is a basis on which to go forward. If you can establish to FEMA's satisfaction that some aspects of your loss are critical and uninsured you may, and I stress may, recover some limited assistance form FEMA. The following is a link to FEMA's website and may be helpful:- www.fema.gov/disaster-help-available-if-I-have-insurance    Thatcher Stone      ... Read More

However, if you think the policy has you as the beneficiary, then you would have to bring an action against your grandmother, which will be difficult. My car got totaled by sandy, I'm trying to talk with my insurance but I haven't got any reply, nothing at all called them everyday

Answered 13 years and a month ago by Sarah Reese (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Insurance
I am sorry to hear about your car and hope that everything else fared well in the storm.  Keep trying to contact the insurance company. They are likely overwhelmed with claims at this time.  I also recommend mailing them a letter by certified mail, return receipt requested explaining your loss and that  you would like to make a claim for the damages to your vehicle.   Read your insurance policy regarding this and be sure to conform to any details.  It is often better to send in the proof of loss by mail so that there is record of it.  Keep calling and send the information by mail as well with all of your contact information.  Hopefully you will get through to someone soon.  Best of luck! Life Insurance Beneficiary

Answered 13 years and a month ago by Sarah Reese (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Insurance
No.  Attempting to force someone to change a beneficiary is against the law.  The person needs to freely make changes to beneficiaries and needs to be of a sound mind. The person cannot be under any duress or pressure to change beneficiaries.  The fact that you are a caregiver for the ill person would likely equal duress.  This would be illegal.  If you have ever done such a thing before with your position, I recommend you turn yourself in as you likely committed an illegal act and took advantage of someone who depended on you. NOTE:  This response should not be considered legal advice.  No attorney-client relationship exists or is formed by this response. ... Read More
