QUESTION

Is Loss of Use applicable for perils covered under an endorsement?

Asked on Jan 06th, 2013 on Insurance - New York
More details to this question:
The endorsement for sewer back up was paid up to the limit of liability. The insurance company states, they are not liable to pay the additional living expenses; incurred as the home was uninhabitable due to a covered peril; as they paid up to the limit of liability stated on the endorsement.

Well the precise correct answer depends uppon a read of the policy. If the policy is clear that the sewer endorsement adding a peril had a different limit of liability than the balance of the coverage, then there could be an issue for obtaining the exta coverage you seek. However, it depends on the wording also of the habitability coverage and its wording. Unable to answer definitively without sight of the policy.
