How to get Disney to approve treatment for a lifetime medical workers’ comp injury?

I worked for Disney for 30 years. I worked in a kitchen and we had to carry and lift very heavy things. I injured my wrists, shoulders, and entire spine. I had a workers’ comp claim and received lifetime medical. I am in severe pain all the time. I have crushed discs that are pressing on nerves. I am honestly in severe pain 24 hours a day. I have been given narcotics and they do not relieve the pain. The problem is, Disney continues to deny treatment that I clearly need. The WC case was settled in 2007. I continued to work until I could no longer tolerate the pain. It seems as if Disney had s intentionally making it difficult for me to get treatment. I have an attorney but there’s no money in it for her so it seems like she’s not so concerned with my treatment. I do not know what to do. What I have given you is just the tip of the iceberg. I have all the documentation. Do I hire another attorney and start over? Can I sue Disney for denying treatment?

That is one of the main problems with getting lifetime medical for your work injury.  The employer/insuranced company still controls your medical treatment.  A possible option is to have the them buy out your future medical to close out your case.  This would allow you to have control over your medical treatment.  However, the insurance company has to agree to this as well.  Please contact me if you want to discuss this further.   Cyrus Chen CCC Law Group 949-888-9807
