QUESTION

How can it affect a US Citizen to marry someone with an expired visa seeking a greencard?

More details to this question:
I am a natural born US Citizen. I am a Widow and I receive Survivor benefits from Social Security and I am also Disabled and receiving SSDI. I am 58 years old. I am thinking about getting married to a person who was born in Serbia and has an Expired F1 Visa. SShe tells me that Immigration is currently not doing interviews and I have no chance of losing my benefits. What, if anything, could I be looking forward to as far as getting in trouble for doing this. She also says that she has a "Guarantor".

OK, so a US citizen can sponsor a spouse who entered the United States with a visa. This is true even if the visa is expired, and the immigrant is unlawfully present. Additionally, if your income is insufficient to sponsor the immigrant spouse, you can enlist the help of a joint financial sponsor as long as that person is either a US citizen or a green card holder.  You should retain an immigration attorney here in Florida to handle the case from start to finish, so that no mistakes or delays are made. Some of us charge a reasonable flat fee to handle the case from start to finish.
