What should I do if a ceramic box fell on my foot while I was at a hardware store?

More details to this question:
I went to a hardware store and a ceramic box fell on my foot. It did not break but my chiropractor told me I might have chronic pain for the rest of my life. What should I do?

Make a claim on the hardware store and its insurance company. Don't settle until you know the extent of your damages and disability.

Your chiropractor is acting outside of his specialty, which is backs and spines. Why did the box fall? Were you touching anything on the shelf? If so, the insurance company for the store is going to blame you for causing the box to fall. I think that you need a lawyer. I also think that you should ignore the chiropractor. Talk to a podiatrist or an orthopedic specialist, but only if it still hurts after a week or two. In the meantime, speak to your family doctor to make sure there are no fractures or soft-tissue problems.

A property owner or business proprietor can be held liable for known hazards that could foreseeably result in injury. In order to make a claim the injured party has to show either that the owner knew or should have known of the hazard, had an opportunity to correct it, and failed to take action or that the property owner created the hazard. So, you have to show how it was that this ceramic box fell and that it fell due to a condition that the store employees created or knew about (or should have known about) but failed to correct. There is another possibility: some property liability insurance policies include a provision called a "medical payments provision". Although it is not required, this provision will pay medical expenses up to a certain amount, regardless of fault.

What are the circumstances? If the box fell on your foot because of someone else's negligence (particularly an employee of the store) you may have a case. This is very fact sensitive so see an attorney.

You might start by making a claim to the store. You have 2 years from the injury date to file a lawsuit for personal injuries.

If it fell on you through no fault of your own, then you may have a claim against the store. These are difficult cases. I would advise that you find an attorney right away and have he or she immediately demand that they preserve any videos for that day. If you did not report it to the store on the day of the incident, you should do that now.
