If the police officer violated your right to privacy or some other privacy rule, you may be able to sue. However, there are many landmines and pitfalls in lawsuits against public organizations such as police department and the city for which the police department works,(called "public entities"). In addition, the fact that you are or may be charged with a crime may allow the officer a little leeway, (a little leery, not total).
