QUESTION

If disability claim process can take up to a year, can a person file/collect unemployment benefits during this time?

You should consult with a Rhode Island licensed attorney that has experience in handling Unemployment Applications, Appeals, and Board Of Review Hearings while your Federal Disablity Claim is pending. You may want to ensure that whatever is disabling you is "legally" not workers compensation.

To collect unemployment benefits, you have to be ready, willing and ABLE to work. Otherwise, you are taking the money wrongly and not only will you have to pay it back, but you could run into some criminal issues. If you are able to work, you are not entitled to disability benefits.

It is difficult to maintain a disability claim at the same time one is collecting unemployment as, to receive unemployment benefits it is necessary that the person stated that they are ready willing and able to work. The two concepts are mutually exclusive.

2 unrelated things. If you are entitled to unemployment then you are entitled just because you are awaiting final review of your disability claim does not entitled you to anything that I know of.
