How long is the statute of limitation for a medical malpractice lawsuit in Illinois?

More details to this question:
I had a surgery in Dec 2008 which resulted in 10 subsequent surgeries up till June 2009. I have permanent affects from these surgeries and believe that the surgeon may be liable. Can I still file a suit?

Hi Connie...The time limit is 2 years from the date that you know or should have known a) that you have been injured and b) that it may have been wrongfully caused, but in no event more than 4 years from the date of the negligent acts. There are exceptions, for children and people who are totally disabled cognitively. If you remained under the defendants' care continuously, then the 2 years begins to run at the time when you stopped seeing the defendant, although the 4 year period from the date of the negligent act still applies.
