Asked on Apr 06th, 2013 on Labor and Employment - Wisconsin
More details to this question:
There is an employee who has created a hostile work environment and despite complaints from other managers, employees, as well as members of the same department upper management has yet to fully discipline his actions. This person uses race to intimidate others as well as management. What can I do? I've tried to simply ignore but it's becoming overwhelming.

General type of bullying in the workplace is not illegal. However, bullying on the basis of race can be illegal if it is severe or pervasive in nature. If so, then, you could have a claim of race discrimination based upon a hostile work environment under federal and/or state law.

Complain to HR. If based on race, complain to the EEOC. If you want to "outsource" and get legal representation, we represent workers who have such problems.

The term "hostile work environment " is over used and mis-used. It is limited to Race, Age, Sex, National Origin, Religion, Handicap, usually sexual discrimination. "Hostile work environment " does not refer to an unpleasant place to work or working around unpleasant persons. I do not have enough facts to know if you do in fact have a "hostile work environment.
