QUESTION

Who is responsible for damages if wind blows a trailer into someone else's trailer in a storage lot?

Asked on Oct 29th, 2024 on Insurance - Florida
More details to this question:
My trailer was chocked and ready for hurricane Milton. Someone took all but one chock from my trailer wheels for their own trailer. The 80+ MPH wind blew my trailer into another trailer with a boat on it. The owner of the boat is demanding that I pay 100% of the damages. Am I liable or is considered an act of nature? He sent me one estaminet for about $900.00.

This is likely subject to an "act of God or nature" defense and you have no liability and owe nothing. HOwver, if he can show that you negliently secured your trailer and had you done so properly your trailer would not have moved, he might have a legal argument for some liability.
