QUESTION

When a repair shop damages your vehicle.and your insurance don't step up to recover your cost.

More details to this question:
I was driving home from visiting family out of state and a rock from another vehicle hit my windshield and cracked it. I reported to my insurance and they said it was ok to take it to a near by shop that replaces and repairs windshields. after the replacement I noticed the shop had damaged my vehicle and the windshield they had put in had slid down leaving a open gap on the top of the windshield. I called my Insurance they arranged for a mobile service to come look and fix the windshield. The service tech said that the shop had not put any adhesive and they had installed the wrong windshield . I paid a $500.00 deductible and the insurance company arranged for me to take it to get repaired. The insurance company said that I would get my deductible back as soon as they go after the shop that did the damages. About 6 month go bye and I get a letter saying the person responsible for the incident appears to have no insurance so they are closing the case.

Based upon the facts you have indicated, your insurance has declined to subrogate to recover its monies and your deductible, which is usually within the discretion of your insurance company.  You are free to bring an action to recover your $500 deductible yourself.
