QUESTION

What do I do about my mortgage insurance aggressively seeking grounds to drop my policy?

Asked on May 14th, 2013 on Insurance - Washington
More details to this question:
I have only recently learned that my mortgage falls under the predatory lending criteria, as I had been convinced to take out additional equity when refinancing a home improvement equity loan during the peak of interest rates and overinflated property values. Now I have negative equity in my house I have owned for 30 years. I feel that a recent and unannounced visit from an insurance representative is to lay groundwork to justify cancellation in the form of demanding certain maintenance repairs and citing what he called "fire hazards" (stack of laminate flooring waiting to be installed near a non-operating fireplace). I am in a panic to comply. Simultaneously, I have been looking to refinance due to fluctuating interest and a $60,000 balloon payment coming next year that would sink me, yet under current guidelines no one wants to refinance me due to my age (I am now 80 with retirement benefits from the military and social security as income).

At this point you are only speculating your mortgage insurance is seeking grounds to drop your policy. Comply with the "fire hazard" requests and get confirmation that you have complied. If they attempt to drop your policy after that, you may have grounds to pursue an Insurance Fair Conduct action against them. This response is general in nature and is not legal advice. No attorney client relationship is formed by it. Further, the response does not represent the opinions or views of LexisNexis or its affiliated companies.
