QUESTION

emonade Insurance cancelled my policy by mistake, can I sue?

Asked on Aug 24th, 2023 on Insurance - New Jersey
More details to this question:
Hello, I had two Home Insurance policies from Lemonade Insurance. When I requested to cancelled one policy, they cancelled the other one as well by mistake. I found it some later, and made a lot of efforts to re-instantiate the policy, and it is active now. If something happen (fire etc) in this period, I could loose the house, since I was not covered. They give me an confirmation for cancellation as a reply to my original request, that for the first house (first house). But for the second one, which was not requested at all, just sent one email notification, which was there in my junk folder. No mail in my mailbox as well. Do we have a case here? Regards, Sam

Yes, if the fire occurred during the period of time when both polices were cancelled, you may have a case against the insurance company for its mistake in cancelling the other policy.  Your damages will be whatever would have been covered under the policy that was mistakenly cancelled after reducing the amount of the covered loss by the amount of your deductible.
