QUESTION

Am I liable for someone else’s car if my car was rented by someone with full coverage insurance? I own car rental company.

Asked on Apr 26th, 2023 on Insurance - Florida
More details to this question:
I have a car rental company, one of the cars was rented by an individual with full coverage insurance, full rental agreement was signed and done. The car which was rented was in an accident, however the insurance company declined coverage. Now the other party in this case is seeking for damages. The car was in proper condition, there should not be a question of liability due to car condition. Is there liability that needs to be payed in this case if the rental company was not at fault, and everything was done properly?

While the GRAVES amendment may apply, to provide you immunity, there are ways to work around it as it applies to vicarious liability not issues where there is active negligence on the part of the rental company that applied to the crash. You need to report this to your insurance carrier to have them address any claim or lawsuit made.
