Can my fiance get his K1 visa if he crossed the border illegally?

More details to this question:
I am a US citizen and I have a fiance in Mexico. Can he get the K-1 visa even if he has crossed the border illegally? He has been in Mexico for the past three years.

It depends on the amount of time he accumulated in the U.S. before returning to Mexico. If more than 180 days he will also need a waiver in addition o the usual fianc documentation. We will also need to know how many times he crossed the border after accumulating any unlawful presence.
