QUESTION

My daughter being left with my ex mother in law

Asked on Nov 25th, 2018 on Fathers Rights - Florida
More details to this question:
My ex wife is going to be traveling out of the country for the holidays and leaving my daughter with her mother in my home they still live in (they changed the locks and I cannot get in). We currently do not have a custody agreement in place. Am I able to have an officer escort me over there to get my daughter? Would she stay with me until her mother gets back for me to release her back?

If there is no court order in place, you have every right as a father to see your kids. If there is a parenting plan in place, she would need to offer you the "right of first refusal" which means that you as the father have the first choice to supervise the kids if she is not available or out of town. Would need more information to answer your questions. Thanks Chris Ragano Esq.
