Due to the father of the kids and being able to over come the break up he wants to keep her in the state of florida in doing so he has hopes to be back with her. He has filed papers stating that for the benefit of the kids they should not be able to leave the state so that he can be around them. He is not a resident of florida. He currently lives in NY, however plans on moving to Florida in the future. He says that she isnt stable to move to hawaii with the kids being that she does not have a job. I have a job. I am a soldier in the US Army. I would be able to provide for both the kids and my wife. Can a judge order her to remain in Florida know that we are married and i will be able to provide for them. Or will he/she allow her to move to where i am and grant the dad visitation?

My firm handles cases like this all the time. The courts can order either the children to stay or go but your wife would need to file the appropriate paperwork with the courts to seek a relocation. I would suggest having her contact an attorney to see what needs to be filed. I would also suggest having an attorney help her with this case as relocation cases can be complex.
