QUESTION

If we both have signed the divorce papers and it's notarized, is it considered a divorce ?

More details to this question:
We have both signed the divorce papers and it's notarized and we are settling all assets out of court. The divorce papers are not submitted to the court is yet. My think is that in this situation is this considered a divorce or after we go before a judge is legally divorced ?

Dear Anonymous:   Congratulations on resolving your divorce issues amicably.  However, you do still have to file a petition for dissolution of marriage and appear before a judge for the divorce to become final. If you have no children, you can file for a simplified dissolution of marriage, where both your spouse and you file the petition jointly and appear before the judge jointly.
