QUESTION

I want to start divorce procedure in Texas from my husband that lives in California.Is this possible if I do not have an address?

I moved back home, to Texas in 1988. I last saw my husband when he got out of jail in 1987. We never lived together, but in 2006 I was led to believe that he had expired. I can not obtain a death certificate from any county I have tried, so in my people search on the internet all clues lead me to believe he is residing in Emeryville, California, or at least some of his relatives are. There are no children involved from this marriage and I have had no communication with him since 1987 for 15 minutes to tell him to stay away from me and my daughters. I wish to obtain a divorce from this individual so I can move on with my life what steps do I start?

You can obtain a divorce from your spouse in Texas because you have lived in Texas more than six months. It is not a problem that your spouse lives in another county.  To start the proceess, you need to file an original petition for divorce and then it must be determined how to give him notice of the divorce. You must exercise "due diligence" in locating a potential address for him. If you cannot find an address, then you can to serve him by "citation by publication" which means that you are putting a notice in a local newspaper where he lives to notify him of the divorce.
