If a couple has been separated for 10 years will the spouse still be entitled to anything of his?

My boyfriend of 5 years is still married and his wife will not give him a divorce.

Yes, she has rights and you don't. And he doesn't need her consent. He can file and the judge can grant a divorce after trial. My guess is he doesn't want to get divorced so he has an excuse to not make a commitment to you.
