QUESTION

If my case was dismissed am I still liable to finish paying my bail bond?

More details to this question:
I was arrested and bailed out by a bondsman. After some time my case was dismissed due to false identification. Now I have a balance with the bail bonds am I still liable to continue making payments? Or can I stop making payments since it was dismissed?

You have a legal obligation to pay the bondsman who got you out of jail whether you win or lose your trial, get the case dismissed, or even if you were falsely accused.

Your bail usually has nothing to do with whether you are convicted, vindicated or the case is dismissed or prosecuted. It is solely to allow you to get out of jail prior to your court appearances and is an incentive for you to attend all of your court appearances. With that being said, you are probably still responsible to pay the bail bondsman the full amount of your bail premium.

You continue to be obligated to pay bail bond fee. That is a contract you signed and it has nothing to do with the eventual outcome of the case.

You contracted with the bondsman to pay him a given amount and in return he would post your bond. Assuming he followed through and posted your bond, you are committed to paying him the agreed upon amount. However, if the bondsman got his money back, you may want to try and negotiate a compromise settlement with him. Your attorney should be able to help you with this.

Your contract with the bail bondsman will provide your answer, generally they provided their service and you are liable to them for it, and trust me, they will collect.
