How do I apply for a fee waiver if I'm filing a demurrer in an action?

There is usually a court form. Go to the clerk's office at the courthouse where the case filed and ask for the form to waive fees.

If you are in California (which I presume you are since you used the word "demurrer"), do the following: Search google for "judicial council forms". Once you get to the forms website, select the appropriate category from the pull down menu and get the fee waiver form and the income and expense declaration. Both these forms need to be filled out online and then printed. There may be additional requirements. Also on the judicial council forms website there should be an information pamphlet you can download that explains about the required qualifications for fee waivers. The court will scrutinize your application carefully, so be sure to read the instructions and make sure you qualify.

This is for criminal defense not just defense. You need a p etition for a fee waiver.

It's a form that you can get at the California Court's website: http://www.courts.ca.gov/forms.htm You will need the FW-001and the FW-003. You can read the information sheet - FW-001 info- at that site as well.
