Can we sue a neighbor harassing my wife/children over a dog?

I am deployed overseas with the U.S. Army. Four months prior to leaving, my wife and I bought a home for our family in a quiet town just west of Indianapolis. The neighbor was seemingly polite and helpful toward me at first while I was home. An interesting conversation with a neighbor on the other side of his home two months after the purchase revealed he had some issues in accounts from her experience. Property lines were an issue and dogs were an issue. I even spoke with a surveyor while researching on whom to clear property issues with. He knew exactly who my neighbor was. Apparently, he had dealt with the man before. He didn't have good words to speak of him. We just received a new puppy prior to me leaving for deployment; a chocolate lab from a friend's litter I purchased. I figured it would be a good responsibility learning experience for the kids while I was away. I also thought the pup would occupy their minds and comfort them as well. I left fully in late September 2013, just before summer was over. The dog has been doing well and the kids love him. He is not a full-time inside pet he sleeps in a kennel and goes out to the yard, leashed up during the day. The first altercation with the neighbor and my wife came two days before Christmas. One of my children was watching the dog from the window and he alerted my wife that the neighbor was yelling at the dog. My wife looked out of the window of our home to see this man screaming in our puppy's face like a maniac on our property. She quickly exited the house and witnessed him throwing snow into the dog's face as he continued to scream. She asked him what he was doing and he started screaming at my wife in the presence of my children! He exclaimed the dog's barking was a nuisance and numerous other expletives. She was shook up and she explained everything to me and decided to hold off reporting until after Christmas was over.

Yes and I would call the police about this also. You might be able to get a retraining order against him.

I do not practice law in Indiana; however, you raise to issues: your interests and those of your neighbor. Was your dog barking. Are there nuisance laws that deal with this. You may or may not be in the wrong. Either way, if the incident occurred on your property, then this man may be guilty of trespass. If this person is a problem, you may want to pursue an anti-harassment order. To do so, you need to speak with an attorney in your area.

Sure you can, just be prepared to cough up a couple hundred bucks per hour in legal fees that your lawyer will surely demand of you to sue.

Have your wife get a no contact order against the neighbor. Include the kids on the order.
