My ex spoke to our mediator on her private line weeks after our 1st mediation right before our 2nd mediation...is this ethical and legal

It depends on the substance and content of what was discussed. If matters pertaining to the substance of the mediation and not just scheduling or generic procedure questions were discussed, then it is unethical.
